DEFINITIONS: The following words or expressions will have the following meaning in the context of these present: - Order: refers to the sales contract entered into between Miguel Ruibal and the customer of his online store. - Products: refers to all the goods and services offered for sale by Miguel Ruibal.
ARTICLE 1 – OBJECT The purpose of these General Terms of Sale is to define the terms and conditions under which Miguel Ruibal offers and sells his Products to his clients. These general conditions of sale will prevail over all other conditions that appear in any other document, except prior, express and written exemption.
Article 2 - ACCEPTANCE OF THE CONDITIONS The customer acknowledges having read, at the time of placing the Order, these general conditions of sale and expressly declares to accept them without reservation. These general conditions of sale regulate the contractual relations between Miguel Ruibal and his client, accepting both parties without reservation.
ARTICLE 3 - ORDER Automatic registration systems are considered proof of the nature, content and date of the Order. Miguel Ruibal will confirm to the client the acceptance of his Order by sending a confirmation message to the email address provided by him. The sale will not conclude until the sending of said order confirmation. Miguel Ruibal reserves the right to reject or cancel any Order from a client, in particular in the event of the insolvency of said client or in the event of non-compliance with the payment of the Order in question or of a previous delivery or a dispute related to the payment of a previous order. The mentions indicated by the client, when entering the information inherent to their Order, link to the latter. Miguel Ruibal is not responsible for errors made by the client in the writing of the contact information of the recipient of the Order, and for delays in delivery or the inability to deliver the Products ordered that these errors may cause.
ARTICLE 4 - PRICE The price is expressed in euros. The price indicated in the order confirmation is the final price expressed with all taxes included. This price includes the price of the Products, the costs of handling, packaging and transporting the Products.
ARTICLE 5 - PAYEMENT The price invoiced to the customer is the price indicated in the order confirmation sent by Miguel Ruibal. The price of the Products is paid by one of the means of payment offered on the site on the day of the actual order. The Order validated by the client will only be considered effective when the secure bank payment center has given its consent to the transaction.
ARTICLE 6 - SHIPMENT After confirmation of the Order and subject to payment of the price of the ordered products, Miguel Ruibal undertakes to send the requested products to his client to the delivery address in the minimum possible time, subject to availability. If applicable, the customer agrees to pay upon receipt, all current and future taxes, duties, and other charges owed in connection with the delivery of such products; Miguel Ruibal's joint liability cannot be compromised at any time in this regard. Delivery will be made by Post Office or by carrier, by standard or certified letter / parcel, according to the customer's choice. In addition, we are not responsible for an extension of delivery times due to the carrier, especially in the event of a strike or loss of the goods. This type of delay may not in any case lead to the cancellation of the order, a reduction in the rate or the payment of damages. Our shipping rates are calculated at the time of purchase based on the destination country. Upon receipt of the ordered Products, the customer or the recipient must check the good condition of the delivered merchandise. In the event that one or more of the Products ordered are missing or damaged, the customer or the recipient must make any reservation with the carrier at the time of delivery. In the event that the customer wants the Products ordered to be delivered to two separate addresses, the latter must place 2 separate Orders.
ARTICLE 7 - RETURN The customer has a period of 7 days from receipt of the Products ordered to return them to Miguel Ruibal for exchange or refund. In this case, the customer must return the Products new and undamaged to the address provided during the return request. In case of exercise of the right of return, Miguel Ruibal undertakes to reimburse the amounts paid by the customer, with the exception of shipping and return costs, within a maximum period of 30 days.
ARTICLE 8 - WARRANTY In all cases, Miguel Ruibal is not responsible for non-compliance with the regulatory and legislative provisions in force in the host country. Miguel Ruibal's liability is systematically limited to the value of the Product in question determined on the date of its sale and without the possibility of recourse. ARTICLE 9 - INTELECTUAL PROPERTY All content on this site is protected by intellectual property. It is forbidden to distribute this content without the prior authorization of its author.
